Terms and Conditions of Service by FastEx
GENERAL PROVISIONS
1.1. This Agreement establishes the specifics of the provision of exchange services by the Online Service.
1.2. The Online Service refers to the internet resource for exchanging virtual money - fast-exchange.io
1.3. Users include individuals and organizations who have agreed to cooperate with the Online Service.
1.4. When mentioned together, the User and the Online Service are referred to as the Parties.
1.5. The Parties agree that this electronic Agreement has equal force with a written contract and is intended to regulate their relationship in the process of consuming/providing exchange services.
1.6. The Agreement is considered a public offer, acceptance of which occurs when the User submits an application for services provided by the Online Service. The application is submitted through the web resource - fast-exchange.io
SUBJECT OF THE AGREEMENT
2.1. The subject of this Agreement is the Services provided by the Service, the description of which is provided on the Service's website.
2.2. The Service offers its services to all Users and does not verify the User's authority to manage these funds and does not supervise the User's operations in any of the Payment systems.
2.3. Payment systems and/or financial institutions bear exclusive responsibility for the funds entrusted to them by the User. The Service cannot be a party to the agreement between the Payment system and/or financial institution and the User and in no way bears responsibility for improper or unauthorized use of Payment system capabilities by the User, as well as for User abuse of Payment system functionality. The mutual rights and obligations of the User and the Payment system and/or financial institution are regulated by the relevant agreements.
2.4. Any initiated operation for exchanging user funds, as well as any other operation offered by the Service to the User, cannot be canceled by the User.
RIGHTS AND OBLIGATIONS OF THE PARTIES
3.1. The Service has the right to suspend or cancel an ongoing operation if information is received from authorized bodies about the User's unlawful possession of funds and/or other information that makes it impossible for the Service to provide services to the User.
3.2. The Service has the right to suspend, refuse to refund, or cancel an ongoing operation if the User violates the terms of this Agreement.
3.3. The Service has the right to cancel an ongoing operation and return the deposited tokens without explanation.
3.4. By making an exchange with or without registration, the User confirms that they agree with these Rules and accept the terms of the Agreement, the User is 18 years old, the laws of their country of residence do not prohibit the use of this Service, and the User does not plan to carry out any illegal activities through the use of the Service.
3.5. By accepting the terms of this Agreement, the User guarantees that they are the lawful owner of the funds and/or cryptocurrency.
3.6. By accepting this User Agreement, the User confirms that they understand the principles of the Service's operation and assume full responsibility for all risks and losses associated with using the Service.
3.7. The Service has the right to refuse the User to process the application without specifying the reason.
3.8. The Service has the right to unilaterally change this agreement.
3.9. The Service undertakes to keep the personal data provided by the User confidential. Except in cases when authorized bodies make a request for information about Users based on violations of applicable law.
3.10. Acceptance of this agreement means the User's consent to the processing of their personal data and the transfer of the provided payment details. This data may be transferred to counterparties and partners of the service exclusively for making payments.
EXCHANGE OPERATIONS
4.1. Questions and claims regarding applications are accepted within 24 hours from the time of registration. After 24 hours, exchange applications are considered properly executed or unpaid depending on their status at the expiration of the specified period.
4.2. The Service does not fix the exchange rate at the time of creating the application, but recalculates the rate in accordance with price changes on the exchange. The rate is fixed only at the moment when the Service receives funds from the User to its account. Funds are considered received after the actual receipt of funds to the Service's account or when the transaction gains the required number of confirmations.
4.3. Applications requiring operator participation are processed during business hours (10:00 — 00:00 MSK).
4.4. Applications in which 10-100 times less cryptocurrency is sent (for example, the application specifies 0.1 BTC, but 0.01 BTC is sent) will be paid minus 10% (a recalculation fee will be withheld) from the amount actually received.
4.7. If the User decides to cancel the application, a commission of 5% + network fee will be withheld from the amount.
4.8. If the card specified by the User in the application does not match the selected bank, a refund or payment will be made with a 5% commission withheld from the exchange amount.
4.9. The User undertakes to pay the application within one hour.
4.11. The Service undertakes to pay the User's application within twenty-four hours.
4.12. The User has the right to receive consultations before, during, and after the exchange through any official means of communication with the service listed on the contacts page of the Service's website. The User also has the right to interact with the Service in any force majeure circumstances through the official means of communication with the Service listed on the contacts page of the Service's website.
4.13. The Service has the right to split the sending of funds for the Application into several transactions, the number of which can vary from 1 to 5. The minimum amount of one transfer may be from 1 rub. to 10 rub. When creating an application, the User automatically agrees to confirm each transaction. The Service has the right to request additional documents (photos, video recordings, bank statements and other confirmations). The transfer of funds is possible only if the User has access to the bank's personal account; transfers of funds to third parties are prohibited.
